1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the services provided by N8Nme.com ("N8Nme", "we", "us", or "our"), including our website, managed n8n hosting, workflow library, and any related features (collectively, the "Service").

By registering for an account or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By creating an account, you represent and warrant that you meet these requirements.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refer to that entity.

3. Your account

You are responsible for maintaining the security of your account credentials. Do not share your password or allow others to access your account. You are responsible for all activity that occurs under your account.

You must provide accurate and complete information when registering. If any of your information changes, you are responsible for updating it promptly via your account settings.

You must notify us immediately at support[at]n8nme[dot]com if you suspect any unauthorised access to your account.

4. Subscriptions and billing

N8Nme offers both a free tier and paid subscription plans. Paid plans are billed on a monthly basis.

5. Acceptable use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to:

• - Violate any applicable local, national, or international law or regulation
• - Send spam, unsolicited messages, or engage in phishing or fraudulent activity
• - Distribute malware, viruses, or any other malicious or harmful code
• - Attempt to gain unauthorised access to any system, network, or third-party service
• - Infringe the intellectual property rights of any third party
• - Use the Service in a way that imposes an unreasonable load on our infrastructure or interferes with other users
• - Resell or sublicense access to the Service without our prior written consent

Violation of this section may result in immediate account suspension or termination, at our sole discretion.

6. Your content and data

You retain full ownership of all workflows, credentials, and data you create or store within your n8n instance ("Your Content"). We claim no intellectual property rights over Your Content.

By using the Service, you grant N8Nme a limited, non-exclusive licence to host and operate Your Content solely to the extent necessary to provide the Service to you. This licence terminates when your account is closed and your data is deleted.

You are solely responsible for ensuring that Your Content complies with all applicable laws and does not infringe any third-party rights. N8Nme is not responsible for the accuracy, legality, or appropriateness of Your Content.

7. Service availability and uptime

We target a 99.9% monthly uptime SLA for paid plan instances. This excludes scheduled maintenance windows, which we will announce with at least 24 hours' notice where possible, and events beyond our reasonable control.

The free plan is provided on a best-effort basis without an uptime guarantee.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable advance notice of any significant changes that affect paid subscribers.

The N8Nme.com website, platform, branding, and all associated content, excluding Your Content, are owned by N8Nme and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our prior written permission.

n8n itself is open-source software licensed under the Sustainable Use License. Your use of n8n within your instance is subject to that licence in addition to these Terms. N8Nme is an independent hosting provider and is not affiliated with n8n GmbH.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Service at your own risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, N8Nme shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, lost profits, or business interruption) arising from your use of or inability to use the Service.

In no event shall our total aggregate liability to you exceed the amount you paid to us in the 12 months immediately preceding the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud or personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold harmless N8Nme, its officers, employees, and agents from any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising from your use of the Service, Your Content, or your breach of these Terms.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. If you are a consumer residing in the EU, you may also benefit from mandatory consumer protection provisions of the law of your country of residence.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by contacting us at support[at]n8nme[dot]com. If we cannot reach a resolution within 30 days, the dispute may be submitted to the competent courts of the Netherlands.

14. Changes to these terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email or via a notice in your dashboard at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you disagree with the changes, your remedy is to cancel your subscription before they take effect.

15. General

• - Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and N8Nme regarding the Service.
• - Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• - No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• - Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations at any time.
• - Language. These Terms are written in English. In the event of any conflict between a translated version and the English version, the English version shall prevail.
